FCC Upholds SHC Ruling on Sepa DG Appointment Criteria in Pakistan

The Federal Constitutional Court (FCC) has dismissed petitions filed by the Sindh government and upheld the Sindh High Court (SHC) ruling regarding the appointment criteria for the Director General of the Sindh Environmental Protection Agency (SEPA).

The court ruled that the appointment must strictly follow the legal and technical framework defined under the Recruitment Rules 2009, emphasizing that the position requires specialized environmental expertise along with administrative capability.

According to the judgement, the case arose after a Sindh government notification issued on July 21, 2025, which allowed the SEPA DG post to be filled through transfers from administrative services without clearly mentioning technical qualifications. The SHC earlier declared this approach inconsistent with the required legal standards.

In its detailed judgment, the FCC highlighted that the role of SEPA is directly linked to the protection of fundamental rights under Articles 9 and 9-A of the Constitution of Pakistan. These provisions ensure the right to life and a clean, healthy, and sustainable environment for citizens.

The court further noted that ignoring technical qualifications could weaken environmental governance and lead to the appointment of individuals lacking the required expertise to handle pollution control and environmental protection challenges.

The bench also supported SHC directions for reviewing existing appointments and verifying academic credentials through the Higher Education Commission (HEC), ensuring transparency, merit, and compliance with the law.

This judgment reinforces the importance of merit-based appointments in specialized regulatory institutions and strengthens environmental governance in Pakistan.
