A private company in Pakistan has been fined Rs1.2 million by the Federal Ombudsperson for Protection against Harassment (FOSPAH) after unlawfully terminating a female employee during her approved maternity leave. The decision is being viewed as a significant step toward protecting women’s workplace rights and ensuring employers comply with labor laws.
According to the findings, the employee was working in the accounting department of the company and had been granted official maternity leave. During this legally protected period, she unexpectedly received a phone call informing her that her employment had been terminated. The incident raised serious concerns regarding workplace discrimination and the violation of maternity leave protections.
Federal Ombudsperson Fozia Waqar ruled that dismissing an employee during maternity leave is an unfair labor practice and a violation of women’s legal rights. The ruling emphasized that maternity leave is protected by law and employers cannot terminate or penalize female employees simply because they are exercising this right.
FOSPAH further stated that such actions amount to gender discrimination and may also be considered psychological harassment under Pakistan’s anti-harassment laws. The authority stressed that organizations have a responsibility to provide a safe, respectful, and discrimination-free working environment for women.
In addition to imposing the Rs1.2 million fine, FOSPAH ordered the company to implement institutional reforms aimed at preventing similar incidents in the future. The organization has also been instructed not to take any retaliatory action against the complainant.
The decision sends a clear message to employers across Pakistan that violating maternity leave laws can result in serious legal and financial consequences. It also reinforces the government’s commitment to protecting female employees and promoting equal opportunities in the workplace.
Legal experts believe this ruling will encourage more women to report workplace discrimination and strengthen awareness about employee rights. Employers are also expected to review their workplace policies to ensure compliance with labor regulations and anti-harassment laws.
Overall, this landmark decision highlights the importance of respecting maternity leave, preventing gender discrimination, and creating a fair and inclusive work environment where women can continue their careers without fear of unlawful dismissal.
